1. Introduction

Thank you for choosing e-Affidavit Services for your notary public and affidavit deposition services. These Terms and Conditions ("Terms") govern the use of our services. By using our services, you agree to be bound by these Terms.

2. Services Offered

We offer the following services:

  • Oaths and Affidavit Deposition: We offer a vast template of affidavits, ready for easy adoption, modification and adaption to meet your needs. We will assist you in preparing and swearing an affidavit. A notary public or a Commissioner for Oaths will witness your signature and administer the oath.
  • Notarisation: We will notarise documents following applicable laws and regulations. We have notary publics with whom you can connect online instantly that will help you notarise your documents.

3. Fees and Payment

  • Fees for notary public services are available upon request. Once you have filled out your affidavit template and booked an appointment with your chosen notary, they will provide the pricing for their services during your virtual meeting.
  • Fees for the services of a Commissioner for Oaths within a state and judicial division are fixed as determined by the relevant agency or state ministries of justice.
  • We charge 10% of the quoted amount by a notary and of the fixed rate for Commissioners for Oaths. We reserve the right to revise this platform charge with or without notice to you. Payment is due at the time of service. We accept debit cards and other recognised modes of payment offered by our third-party payment service providers.

4. Identification Requirements

  • For all notary services, you will be required to present a valid government-issued photo ID, such as a driver's license, national ID, permanent voter’s card or international passport during the virtual meeting.

5. Document Requirements

  • Affidavits completed for notarisation or oaths must be complete, true and free of errors, as in compliance with state oaths laws.
  • Documents for notarisation must be complete and free of errors.
  • We reserve the right to refuse to notarize a document if we believe it to be fraudulent, incomplete, or otherwise inappropriate.

6. Regulatory conformity and compliance

We endeavour through best practices to ensure that affidavits generated and produced through our services are compliant with the oaths and notarization laws of the Federation and applicable States onboarded to our platform.

You must access and use our services only for legal, authorized, and acceptable purposes. You will not use our services (or assist others in using them) in ways that: (a) violate, misappropriate, or infringe upon the rights of our users or others, including privacy, publicity, intellectual property, or other proprietary rights; (b) would be illegal or otherwise inappropriate, such as promoting fraud, financial crimes, or money laundering, among others; (c) involve publishing falsehoods, misrepresentations, or misleading statements.

8. Intellectual Property

All content on the e-Affidavit web app, such as text, graphics, user interfaces, visual interfaces, custom photographs, trademarks, logos, and computer codes, including the design, structure, selection, coordination, expression, "look and feel," and arrangement of such content is either owned, controlled, or licensed by Lextech Ecosystems Limited. It is protected under copyright, patent, trademarks, and trade dress laws, as well as other intellectual property rights and unfair competition laws.

Unless expressly provided in these Terms of Use or by written authorisation, no part of the web app and its content should be reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, or distributed in any way, including to any other computer, server, website, or other medium for publication or distribution, or for any commercial enterprise, without the express prior written consent of LexTech Ecosystems.

All copyright, trademarks, and other intellectual property rights used as part of our services or contained on the App belong to us or its licensors. Nothing outlined in these Terms of Use shall constitute a transfer, license, or assignment by us to you of any Intellectual Property Rights owned by us or displayed on the App.

You may be liable to legal action where we establish an infringement.

9. Third Party Services

Our Service may be integrated with or allow you to access, use, or interact with third-party websites, applications, content, and services (such as payment gateways, etc.). Please note that these Terms and our related Privacy Policy apply only to the use of our Services. When you use third-party products or services their terms and privacy policies will govern your use of those products or enabled services.

You are responsible for ensuring that all information provided in connection with our services is accurate and complete.

11. Disclaimer of Warranties

WE PROVIDE OUR SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR GUARANTY AS TO THE ACCURACY, TIMELINESS, COMPLETENESS, OR RESULTS OBTAINED THROUGH THE USE OF OUR SERVICES. YOU USE OUR SERVICES AT YOUR OWN RISK.

12. Limitation of Liability

WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES.

13. Indemnification

By using our services, you agree to indemnify and hold harmless the organisation and its affiliates, officers, agents, and employees from any claims, liabilities, damages, or expenses (including legal fees) arising out of or related to your use of the platform or any violation of these terms and conditions.

We will maintain the confidentiality of all information you provide, subject to applicable laws and regulations.

We reserve the right to terminate your use of our services at any time, for any reason, with or without notice.

These Terms shall be governed by and construed in accordance with the Oaths Act of the Federal Republic of Nigeria and the Oaths Law of various partner States.

These Terms constitute the entire agreement between you and us regarding the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

We reserve the right to amend these Terms at any time by posting the amended Terms on our website.

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
